The General Terms and Conditions govern all relationships between ⁇ Corporation Bulgaria ⁇ Ltd and Users of insurance services (also called Customers) arising from the provision of insurance intermediation services at a distance, electronic orders for insurance products through the website www.insurance.bg and/or the mobile application Insurance.bg, available on Google Play (Android) and AppStore (iOS), as well as the order, manner and conditions under which payments of due insurance premiums will be made through the website www.insurance.bg and/or the mobile application Insurance.bg, available on Google Play (Android) and AppStore (iOS). Each User, using the website www.insurance.bg and/or the mobile application insurance.bg, available on Google Play (Android) and AppStore (iOS) for commissioning the performance of insurance mediation at a distance, declares that he has read these General Terms and Conditions, understands them, accepts them and agrees to the insurance mediation being performed at a distance, according to these General Terms and Conditions.     As an insurance broker, ⁇ Corporex Bulgaria ⁇ EOOD performs insurance mediation on assignment to its clients, users of insurance services and in this connection represents them before insurance companies. ⁇ Corporex Bulgaria ⁇ EOOD has no contractual obligation to conduct insurance intermediation exclusively for one or more insurers and does not provide its advice under Article 325a, paragraph 5 of the Insurance Code and may conduct insurance intermediation for all insurers entitled to operate in the territory of the Republic of Bulgaria, including under the right of establishment and freedom to provide services. In the case of insurance contracts, the term ‘Custodian’ means any natural or legal person, entity or body, other than an insurance intermediary, that is a party to the contract. The customer is obliged to make an informed decision on whether to take out insurance based on the information published on the website www.insurance.bg or the mobile application insurance.bg. For the insurance intermediation carried out, as a result of which an insurance contract has been concluded with ⁇ Corporation Bulgaria ⁇ EOOD, the nature of the remuneration that ⁇ Corporation Bulgaria ⁇ EOOD receives is a commission included in the insurance premium on insurance contracts serviced through its intermediation and paid by the insurance company. All insurers established in the Republic of Bulgaria and third-country insurers having a branch registered under the Commercial Law in the Republic of Bulgaria offering compulsory motorists’ liability insurance and/or compulsory accident insurance for passengers or insurance under Section I of Annex 1 shall make contributions to the Guarantee Fund in the amount and in the manner determined under the Insurance Code. Insurers from Member States offering compulsory motorists’ liability insurance and/or compulsory accident insurance for passengers in the Republic of Bulgaria, subject to the right of establishment or the freedom to provide services, shall make contributions to the fund under Article 521 (1) (1) of the Code. A person who is not a member of the insurance undertaking shall be deemed to be a member of the insurance undertaking if the insurance undertaking is established in a Member State other than the Member State in which the insurance undertaking is established. • User ⁇ natural person using the distance insurance intermediation service provided by the Broker through the website www.insurance.bg and/or the mobile application Insurance.bg, available on Google Play (Android) and AppStore (iOS), who acts outside the scope of his commercial or professional activity. • Insurance policy ⁇ the form in which the insurance contract is concluded between the Insurer and the Client (through the intermediary of the insurance broker ⁇ Corporex Bulgaria ⁇ Ltd.). • Electronic order – an application made for the provision of insurance services through the website www.insurance.bg and/or the mobile application Insurance.bg, available on Google Play (Android) and AppStore (IOS), where within the application the Client enters his personal and/or other data for the needs of the insurance policy. • Distance financial services contract – any contract concluded between a provider and a customer as part of a distance financial services system organised by the provider, in which the parties use one or more means of distance communication from the time the offer is made to the conclusion of the contract. • Insurer – the person who is party to the insurance contract. • Insured person – is the person whose property and/or non-property is the subject of insurance protection under an insurance contract.


    III. Other Products and services offered Through the website www.insurance.bg and/or the mobile application Insurance.bg, available on Google Play (Android) and AppStore (iOS), the User of insurance services has the possibility to conclude a distance contract for insurance products for which the Insurance Broker has allowed such a possibility or to check the validity of already concluded insurance and to pay the due premium on already issued insurance policy without having to visit a physical office. IV. The form of the declaration. The contract is concluded for a period of five years. The insurance broker and the Client agree that in all relations between them carried out through the website www.insurance.bg or the mobile application insurance.bg, the Client signs electronic statements or documents by ticking the ‘check box’ or pressing a virtual button, which is an electronic signature according to the SEA and has the value of a handwritten signature. The Insurance Broker and the Client agree that in all relations between them carried out through the website www.insurance.bg or the mobile application insurance.bg, the Insurance Broker signs electronic statements or documents by means of a Qualified Electronic Signature under the CSA, which has the value of a handwritten signature. By ticking the „check box“ or pressing the appropriate virtual button, the Client entrusts „Corporex Bulgaria“ Ltd. to conclude and sign on behalf of the Client and for its account an insurance contract under the conditions and with an insurance company that the Client has chosen, using the website www.insurance.bg or the mobile application insurance.bg. The contract is concluded at the initiative of the Client for each individual electronic order and terminates with the fulfilment of the obligation of the Insurance Broker to deliver to the Client the insurance policy, receipts, stickers and all accompanying documents by e-mail (e-mail) and payment of the due premium by the Client. The broker has the right to refuse the conclusion of the contract in case the Client has not provided all the necessary information, as well as when he has not provided a document which according to the regulations or the conditions of the relevant insurer is necessary for the conclusion of the contract of assignment or the insurance contract. In the event that the Broker refuses to conclude the contract, it shall notify the Client by means of a message made through the website www.insurance.bg and/or the mobile application insurance.bg, available on Google Play (Android) and AppStore (iOS), or sent to the email indicated by the Client. The contract shall be terminated in the following cases: • by mutual written agreement of the parties; • unilaterally by the party liable, in the event of the other party’s culpable breach of duty; • without the express consent of any of the parties, after the cumulative fulfilment of the following requirements: fulfilment of the obligation of the Insurance Broker to provide the Client with the insurance policy, receipts, stickers and all accompanying documents by e-mail (e-mail) and payment of the premium due by the Client; • in other cases provided for in the General Terms and Conditions and in the legislation in force in the Republic of Bulgaria. The client does not owe any remuneration to the Insurance Broker under the contract of assignment. The broker receives as remuneration a commission included in the insurance premium and paid by the insurance company. V Rights and Responsibilities of the Insurance Broker The broker shall have the right to collect and store technical information that can be used to improve the service provided. The broker shall have the right to change the website and the mobile application and to suspend access to it temporarily or permanently without prior notice to the clients. The Broker may unilaterally and without prior notice to the Client amend these General Terms and Conditions and the amended General Terms and Conditions shall be effective as of the date of their publication on the website www.insurance.bg or the mobile application. Provided that the Client does not agree with the new version of the General Terms and Conditions, he has the right to terminate the contract by unilateral notice, which may not be less than three days and not more than one month, during which period the General Terms and Conditions in force before the last amendment apply; The broker shall be entitled to require any necessary information and documents relating to the conclusion, operation, performance and termination of the contract of award or the insurance contract.

    The broker shall:

    1. provide information on the Insurance Broker, the Insurer, the insurance service and the insurance contract in accordance with the requirements of Article 8 of the Distance Provision of Financial Services Act and in accordance with Articles 324-328 of the Insurance Code, including: information on the Insurer; on the insurance product (general or special conditions); the final price including all taxes and fees; any additional costs of transport, delivery or postage, and where these costs cannot be calculated in advance within reasonable limits, the fact that such additional costs may be due to the Client; the manner of payment and performance of the service; or the absence of the right of the Client to withdraw from the insurance contract concluded at a distance, as well as the terms and conditions for its exercise. The information shall be provided in Bulgarian, in a clear and comprehensible form so as to enable the Client to make an informed decision.
    2. send the policy and accompanying documents, together with a payment receipt, to the e-mail address (email) indicated by the User, or if the latter has expressly stated that he wishes to receive the documents in paper form ⁇ to the address indicated by the Customer by courier and at the expense of the User;
    3. report in due time to the insurer concerned the policies taken out and the payments received under them;
    4. take the necessary care to ensure that the data, information and information are kept correct and up to date at all times, including: keeping records that the necessary information has been provided to the user of the insurance service, who has read it and accepted it, as well as keeping records of transactions for the purpose of a successful payment; documenting that the user’s consent to conclude a distance contract has been obtained;
    5. to provide assistance, if explicitly requested by a Client with a valid contract of assignment, in the settlement of claims arising from an insurance event.
      ⁇ Corporex Bulgaria ⁇ EOOD shall not be liable for data entered incorrectly or in bad faith by the Client, as well as for damages resulting from the use of other people’s personal data in violation of these Terms of Use.
      ⁇ Corporation Bulgaria ⁇ EOOD shall not be liable for damages caused by circumstances beyond its control, such as: problems related to access and connection to the website; problems due to the Client’s equipment, as well as in the case of unregulated access by third parties to the operation of the information system or servers of ⁇ Corporation Bulgaria ⁇ EOOD.
      ⁇ Corporex Bulgaria ⁇ EOOD shall not be liable for damages in the event that the Insurer refuses to conclude, amend, extend or terminate an insurance contract with the Client without there being culpable non-performance of an obligation of the Broker, as well as for damages if the Insurer amends or terminates or terminates an insurance contract with the Client without there being culpable non-performance of an obligation of the Broker. In such cases, the Client should contact the relevant Insurer.
      The insurance broker shall not be obliged to make a recommendation based on a fair analysis as to which insurance is most appropriate in view of the needs of the consumer. The customer is obliged to make an informed decision on whether to take out insurance based on the information published on the website www.insurance.bg or the mobile application insurance.bg.
      VI. The rights and obligations of the user of the insurance products and services.
      The customer is obliged to enter correct information about his personal data as well as correct information in connection with the conclusion/modification/termination of insurance contracts in connection with the use of the website www.insurance.bg or the mobile application insurance.bg.
      The customer is obliged to monitor and comply with his obligations under the insurance contract, as well as to pay the insurance premiums under the insurance contract concluded through the Insurance Broker.
      The customer shall not be entitled to conclude an insurance contract on behalf of another person, except where he is the insurer and has the express consent of the insured person (s).
      For the period of validity of the insurance contract, the Client is entitled at any time to receive the insurance policy, the terms of the contract or other information at the address indicated by him by e-mail or in paper form, when he expressly so requests. The provision of information shall be effected by delivery of the information in paper form by courier, the amount of the delivery being paid to the courier at the prices specified in his tariff and at the expense of the Client.
      The Client has the right to request additional information about the products offered online through the website www.insurance.bg or the mobile application insurance.bg, for this purpose the Client shall make its enquiries to the indicated contact address of the e-mail or telephone number on the website of the Insurance Broker.
      The Client has the right to seek the assistance of the Broker in the event of:

    the insurance product; and that he has read and accepted the information referred to in Articles 324 to 326 of the Insurance Code.
    The customer agrees that the data he enters from his bank card will be registered in the system of the servicing bank, including for the execution of periodic payments on the concluded insurance.
    After sending the electronic order and paying the insurance premium, the Client receives an electronically signed insurance policy, the accompanying documents depending on the insurance and the payment receipt, which are also displayed in the customer profile on the website www.insurance.bg or the mobile application Insurance.bg, at the indicated email address.
    By sending the electronic order, the Client gives his express consent to the Insurance Broker/Insurer to start the execution of the contract before the expiry of the 14-day period in which the Client can exercise his right of withdrawal, according to the requirements of Article 13, paragraph 1 of the Distance Financial Services Act.
    When choosing an insurance product ⁇ ⁇ Civil liability ⁇ , the price of the insurance offered may vary depending on the insurance company chosen, the type of vehicle, the term for which the insurance is taken out and the way the vehicle is used in each individual case. The final price is displayed to the Client after full and correct completion of all required data and before final confirmation of purchase of the insurance. The insurance broker shall update insurance prices in a timely manner in the event of changes in insurance company rates.
    In order to take out compulsory motorists’ liability insurance, the Customer is obliged to attach a copy of Part One of the registration certificate of the motor vehicle in respect of which the insurance is taken out, at the same time as sending the electronic order. By sending a copy of the document, the Client declares that it is the same as the original.
    Within three working days of making the payment with a bank card in the name of the insurer under insurance ⁇ Civil liability ⁇ , concluded via the website www.insurance.bg or the mobile application insurance.bg, ⁇ Corporation Bulgaria ⁇ EOOD will send you the signed insurance policy in paper form, signed by the insurer, respectively the insurance intermediary, accompanied by a mark under Article 487 of the Code and a Green Card certificate under Article 488 of the Code. In this case, the signature of the insurer on the insurance policy is not required. In the case of payment of instalments, deliveries of the sticker (excerpt of a sign) shall be made after payment of the next instalment. Documents shall be supplied in paper form by courier service, the cost of which shall be paid to the courier service at the prices specified in its tariff and shall be borne by the Client. ⁇ Corporex Bulgaria ⁇ EOOD does not charge any additional fees for issuing the documents. The insurance contract shall be deemed to be concluded from the moment of receipt by the insurer of the confirmation of the Insurance Broker for the conclusion of the contract at the indicated e-mail address. The entry into force of the insurance coverage is explicitly agreed in the insurance contract, but cannot be earlier than 00.00 on the day following the day of the conclusion of the contract.
    Through the website www.insurance.bg or the mobile application Insurance.bg, the Client can also pay a premium for an already concluded insurance ⁇ Civil liability ⁇ by selecting the menu ⁇ Pay a premium ⁇ and following the steps. Within three working days of making the payment with a bank card in the name of the insurer, ⁇ Corporex Bulgaria ⁇ EOOD sends the Client a receipt for the paid premium in paper form, together with the accompanying documents.
    On the website www.insurance.bg or the mobile application insurance.bg, the Client can check the validity of an already concluded insurance ⁇ Civil liability ⁇ by selecting the appropriate menu ⁇ Verification of CO ⁇ , and follow the steps. The customer will receive the result of the verification to the e-mail address that he has indicated, and the same will be visible on the insurance.bg page immediately after pressing the final virtual button.
    The VIII. Payment methods. The amount of assigned revenue in accordance with Article 21 (3) of the Financial Regulation is estimated at EUR 100000.
    Payment of insurance premium via www.insurance.bg or the insurance.bg mobile application is made using bank cards of the insurer. Payment is made at a virtual POS (VPOS) terminal of Bank DSK AD. All payments shall be made in Bulgarian leva (BGN). For each successful transaction, the Client receives a payment receipt by e-mail. The following types of cards are accepted: debit, credit and business cards Visa and Mastercard. Transactions are carried out using the security programs MasterCard Identity check and VISA Secure.
    From a security point of view, the maximum amount for a card payment is BGN 1,000. Platform

Alternative dispute resolution between consumers and traders is an out-of-court settlement procedure on a voluntary basis. This is done through conciliation commissions. In the event of a dispute between the Client and the Broker that cannot be resolved between the parties, the Client has the right to apply to the Sectoral Conciliation Commission for the settlement of disputes in the field of insurance and insurance mediation (SCC), including the provision of distance financial services in these sectors, by submitting a written application to the Consumer Protection Commission at the following address: He is a member of the European Parliament. The Commission notes that, in the absence of a formal investigation, the Commission has not been able to establish whether the contested tax rulings constitute State aid within the meaning of Article 107 (1) TFEU. A CCP shall resolve disputes after consumers have first referred them for resolution directly to traders. The written conciliation proposal, if any, drawn up by the SCC to settle the dispute is not binding but must be approved by both parties in order to have the force of an agreement between them. Guarantee fund: The amount of the guarantee shall be equal to: All insurers established in the Republic of Bulgaria and third-country insurers having a registered branch in the Republic of Bulgaria offering compulsory motor liability insurance and/or compulsory accident insurance for passengers, or insurance under Section I of Annex 1, shall make contributions to the Guarantee Fund in the amount and in the manner determined in accordance with the Insurance Code. Insurance undertakings from EU Member States which offer compulsory motorists’ liability insurance and/or compulsory passenger accident insurance in the Republic of Bulgaria, subject to the right of establishment or the freedom to provide services, shall make contributions to the fund under Article 521 (1) (1) of the Code. The Guarantee Fund shall have the following functions:

    1. make payments in favour of injured persons for damage caused by a motor vehicle which is unidentified or for which the guilty driver has not taken out a valid compulsory motorists’ liability insurance or where there is no compulsory accident insurance for passengers;

    2. guarantee the claims of injured parties for liability relating to motor vehicles normally situated in the Republic of Bulgaria, under the terms and conditions of this Code, in the event of the insolvency of insurers offering compulsory motorists’ liability insurance and/or compulsory passengers’ accident insurance, which insurers are established in the Republic of Bulgaria or are from a third country through a branch registered in the Republic of Bulgaria;

    3. guarantee the claims arising from insurance under Section I of Annex No 1 in the event of the insolvency of insurers established in the Republic of Bulgaria or in a third country through a branch registered in the Republic of Bulgaria;

    4. set up and maintain an Information Centre which provides information to injured persons in relation to compulsory motorists’ civil liability insurance and compulsory passengers’ accident insurance;

    5. perform the functions provided for in this Code in relation to the insolvency of an insurer;

    1. set up and maintain an electronic information system for risk assessment, management and control, including for issuing insurance policies for compulsory motorists’ liability insurance and compulsory passengers’ accident insurance.

      The following information shall be included in the declaration:
      ⁇ Corporex Bulgaria ⁇ EOOD processes and stores personal data of its customers in accordance with Regulation (EC) 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.       When submitting the electronic order for the conclusion of an insurance contract via the website www.insurance.bg or the mobile application, the Client states an e-mail address and a mobile phone number at which he/she will receive communications from the Insurer. In the event of a change in the requested contact details, the Client is obliged to notify the Insurer immediately and to communicate his new e-mail address or telephone number. Otherwise, all messages are sent to the requested e-mail address and mobile number in the electronic order for the conclusion of a distance insurance contract via the website www.insurance.bg or the mobile application, and the messages are considered to be delivered by the Insurer and received with all the legal consequences provided for in the law or the insurance policy.
      The relationship between the Insurance Broker and the Client shall be governed by the regulations in force in the Republic of Bulgaria.
